Terms of Service

Important: PepCheck AI is a tracking and information tool. It is not a medical device, does not provide medical advice, diagnosis, or treatment, and is not intended to encourage or facilitate the use of any substance. Always consult a qualified healthcare professional before starting, stopping, or changing any compound, supplement, or program.

1. Agreement

By downloading, installing, or using PepCheck AI ("the App"), you agree to these Terms of Service ("Terms"). The App is operated by Bram S., sole trader, Netherlands ("we", "us"). If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years old to use PepCheck AI. By using the App you confirm that you meet this requirement.

3. Your account

You are responsible for keeping your login credentials secure and for all activity on your account.
You agree to provide accurate information when signing up.
You may delete your account at any time from within the App.

4. Subscriptions and billing

PepCheck AI offers an optional paid subscription ("PepCheck Pro") via Apple's App Store as a monthly or annual auto-renewing subscription.
New subscribers may be eligible for a 1-week free introductory trial. The full price is charged at the end of the trial unless cancelled at least 24 hours before the trial ends.
Subscriptions automatically renew at the end of each billing period unless cancelled. Manage or cancel at any time in iOS Settings → Apple ID → Subscriptions.
Prices are shown in the App and on the App Store. Apple may convert prices to your local currency.
Refund requests are handled by Apple under their refund policy.

5. Acceptable use

You agree not to:

Use the App in any way that violates applicable law.
Use the App to facilitate the sale, distribution, or unlawful supply of any substance.
Reverse-engineer, decompile or attempt to extract source code, except as allowed by mandatory law.
Use the App to harass, defame, or harm others, or to upload illegal content.
Circumvent any security or access-control measure.

6. AI features and accuracy

AI-generated content (insights, suggestions, meal/body analysis) is produced by automated language models and may be incomplete or incorrect. Treat AI output as informational only and verify anything important with a qualified professional. We make no warranty as to the accuracy, completeness, or suitability of AI-generated content.

7. Health disclaimer

PepCheck AI is for informational and tracking purposes only. Nothing in the App constitutes medical advice. Peptides, GLP-1 agonists, and many recovery compounds are subject to medical, regulatory and legal restrictions that vary by country. You alone are responsible for the legality and safety of substances you choose to log or use.

8. Intellectual property

The App, its design, code, content and trademarks are owned by Bram S. and protected by copyright and other laws.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes, in accordance with these Terms.
Content you create in the App (logs, notes, photos) remains yours. You grant us a limited license to process it solely to provide the service.

9. Termination

We may suspend or terminate your access to the App if you violate these Terms or pose a risk to other users or to us. You may stop using the App at any time. Termination does not affect Apple-billed subscription periods already paid.

10. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, we disclaim all such warranties.

11. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or other intangible losses, resulting from your use of (or inability to use) the App. Our aggregate liability for any claim arising out of these Terms is limited to the amount you paid us in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited by mandatory law (e.g. consumer rights in the EU).

12. Apple-specific terms (App Store EULA)

These Terms incorporate the additional terms required by Apple for apps distributed via the App Store, including:

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App.
Apple is not responsible for any product warranties, whether express or implied by law.
Apple is not responsible for addressing any claims you have relating to the App, including product liability, legal compliance, or intellectual property claims.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer-protection law in your country of residence grants you the right to bring a claim in another forum.

14. Changes

We may update these Terms from time to time. If we make material changes we will notify you in-app or by email. Continued use of the App after the changes take effect constitutes acceptance.

Algemene Voorwaarden

Belangrijk: PepCheck AI is een tracking- en informatietool. Het is geen medisch hulpmiddel, geeft geen medisch advies, diagnose of behandeling, en is niet bedoeld om het gebruik van enige stof aan te moedigen of mogelijk te maken. Raadpleeg altijd een gekwalificeerde zorgverlener voordat je een stof, supplement of programma start, stopt of wijzigt.

1. Overeenkomst

Door PepCheck AI ("de App") te downloaden, installeren of gebruiken, ga je akkoord met deze Algemene Voorwaarden. De App wordt geëxploiteerd door Bram S., eenmanszaak, Nederland ("wij", "ons"). Ga je niet akkoord, gebruik de App dan niet.

2. Toegestane gebruikers

Je moet minimaal 18 jaar zijn om PepCheck AI te gebruiken. Door de App te gebruiken bevestig je dat je aan deze voorwaarde voldoet.

3. Je account

Je bent verantwoordelijk voor het veilig houden van je inloggegevens en voor alle activiteit op je account.
Je verstrekt correcte informatie bij registratie.
Je kunt je account op elk moment verwijderen vanuit de App.

4. Abonnementen en betalingen

PepCheck AI biedt een optioneel betaald abonnement ("PepCheck Pro") aan via Apple's App Store, als maandelijks of jaarlijks automatisch verlengend abonnement.
Nieuwe abonnees komen mogelijk in aanmerking voor een gratis introductie-trial van 1 week. De volle prijs wordt aan het einde van de trial in rekening gebracht, tenzij minstens 24 uur voor afloop opgezegd.
Abonnementen worden automatisch verlengd aan het einde van elke factureringsperiode, tenzij opgezegd. Beheer of opzeggen via iOS Instellingen → Apple ID → Abonnementen.
Prijzen worden in de App en in de App Store getoond. Apple kan deze omzetten naar je lokale valuta.
Restitutieverzoeken lopen via Apple onder hun restitutiebeleid.

5. Toegestaan gebruik

Je gaat ermee akkoord om niet:

De App te gebruiken op een manier die in strijd is met de geldende wet.
De App te gebruiken om de verkoop, distributie of onrechtmatige levering van enige stof mogelijk te maken.
De App te reverse-engineeren, decompileren of broncode te extraheren, behalve voor zover toegestaan door dwingend recht.
De App te gebruiken om anderen lastig te vallen, te beledigen of te schaden, of om illegale content te uploaden.
Beveiligings- of toegangsmaatregelen te omzeilen.

6. AI-functies en juistheid

Door AI gegenereerde content (inzichten, suggesties, maaltijd-/lichaamsanalyses) wordt geproduceerd door geautomatiseerde taalmodellen en kan onvolledig of onjuist zijn. Beschouw AI-output als puur informatief en verifieer belangrijke zaken altijd bij een gekwalificeerde professional. We bieden geen garantie op juistheid, volledigheid of geschiktheid van AI-gegenereerde content.

7. Gezondheidsdisclaimer

PepCheck AI is uitsluitend bedoeld voor informatieve en tracking-doeleinden. Niets in de App vormt medisch advies. Peptiden, GLP-1-agonisten en veel recovery-stoffen zijn onderhevig aan medische, wettelijke en juridische beperkingen die per land verschillen. Jij bent als enige verantwoordelijk voor de legaliteit en veiligheid van stoffen die je kiest te loggen of te gebruiken.

8. Intellectueel eigendom

De App, het ontwerp, de code, content en handelsmerken zijn eigendom van Bram S. en beschermd door auteursrecht en andere wetten.
We verlenen je een persoonlijke, niet-exclusieve, niet-overdraagbare, herroepbare licentie om de App te gebruiken voor je eigen niet-commerciële doeleinden, in overeenstemming met deze voorwaarden.
Content die jij in de App maakt (logs, notities, foto's) blijft van jou. Je verleent ons een beperkte licentie om deze te verwerken, uitsluitend om de dienst te leveren.

9. Beëindiging

We mogen je toegang opschorten of beëindigen als je deze voorwaarden schendt of een risico vormt voor andere gebruikers of voor ons. Je kunt op elk moment stoppen met het gebruik van de App. Beëindiging tast reeds betaalde Apple-abonnementsperiodes niet aan.

10. Geen garanties

De App wordt geleverd "as is" en "as available" zonder enige uitdrukkelijke of impliciete garantie, inclusief garanties van verkoopbaarheid, geschiktheid voor een bepaald doel of niet-inbreuk. Voor zover de wet dat toelaat wijzen we al deze garanties af.

11. Beperking van aansprakelijkheid

Voor zover de wet dat toelaat zijn wij niet aansprakelijk voor indirecte, incidentele, bijzondere, gevolg- of punitieve schade, of voor verlies van winst, data, goodwill of andere immateriële schade voortvloeiend uit het gebruik (of onmogelijkheid tot gebruik) van de App. Onze totale aansprakelijkheid voor enige vordering uit deze voorwaarden is beperkt tot het bedrag dat je in de 12 maanden voorafgaand aan de vordering aan ons hebt betaald. Niets in deze voorwaarden beperkt aansprakelijkheid die niet door dwingend recht kan worden beperkt (zoals consumentenrechten in de EU).

12. Apple-specifieke bepalingen (App Store EULA)

Deze voorwaarden bevatten de aanvullende bepalingen die Apple vereist voor apps die via de App Store worden gedistribueerd:

Deze voorwaarden zijn tussen jou en ons, niet met Apple. Apple is niet verantwoordelijk voor de App of de content.
Apple is niet verplicht om onderhoud of ondersteuning te leveren voor de App.
Apple is niet verantwoordelijk voor productgaranties, expliciet of impliciet.
Apple is niet verantwoordelijk voor claims die jij hebt met betrekking tot de App, inclusief productaansprakelijkheid, wettelijke compliance of intellectueel eigendom.
Apple en haar dochterondernemingen zijn derde-begunstigden van deze voorwaarden en mogen ze tegenover jou afdwingen.

13. Toepasselijk recht en geschillen

Op deze voorwaarden is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland, tenzij dwingend consumentenrecht in jouw land van verblijf je het recht geeft om een vordering elders aanhangig te maken.

14. Wijzigingen

We kunnen deze voorwaarden van tijd tot tijd bijwerken. Bij belangrijke wijzigingen informeren we je in-app of per e-mail. Voortgezet gebruik na de wijzigingen geldt als acceptatie.
